Please note that we are unable to verify whether material uploaded to our site by any user of our site is Infringing Material, accordingly will shall have no responsibility or liability in relation to any infringement of the intellectual property rights of others, or in relation to any loss arising (whether directly or indirectly) from or as a result of the same.

We respect the intellectual property rights of others and wish to ensure that our site does not contain material which infringes those rights. Accordingly we have adopted this Intellectual Property Rights Infringement Policy to provide a process by which the holders of intellectual property rights can inform us if they become aware of any content on our site which they believe infringes their intellectual property rights.

In accordance with our Acceptable Use Policy we may immediately remove any material uploaded to our site where we determine, in our absolute discretion, that there has been a breach of our Acceptable Use Policy and suspend or terminate use of our site by any person uploading such material.

NOTICE OF INTELLECTUAL PROPERTY RIGHTS INFRINGEMENT

We set out below the process by which you can inform us if you become aware of any content on our site which you believe infringes your intellectual property rights.

If you believe in good faith that your intellectual property rights have been infringed (Infringement) we would invite you to provide us with written notice (Infringement Notice) of such Infringement containing the following:

1. A description of the intellectual property rights you claim have been infringed, together with any evidence of ownership of such intellectual property rights;

3. Your contact details;
4. A statement by you that the information in your notice is accurate and, where you are unable to produce any evidence of ownership of the relevant Intellectual Property Rights, a statement that you are the owner of the intellectual property rights relating to the Infringement or that you are authorised to act on the owner’s behalf.

COUNTER-NOTICE OF INTELLECTUAL PROPERTY RIGHTS INFRINGEMENT

Upon receipt by us of an Infringement Notice relating to material posted by an Alleged Infringing User, we shall use our reasonable endeavours to pass a copy of that Infringement Notice to the relevant Alleged Infringing User.

Where, as an Alleged Infringing User, you receive an Infringement Notice and you believe that the material posted by you to which the Infringement Notice relates, is not Infringing Material, we would invite you to submit to us a written counter-notice (Infringement Counter-Notice).

The Infringement Counter-Notice should contain a statement by you, as the Alleged Infringing User, that you are the owner of the intellectual property rights the subject of the Infringement Notice or that you have the right to use such intellectual property rights, together with any evidence supporting such statement.
